Terms of Use

Introduction to the User Agreement:

Noon Star online store is officially registered in the Kingdom of Saudi Arabia, welcomes you and informs you that you will find below the terms and conditions regulating your use of this store and all legal effects resulting from your use of the store's services over the Internet via this electronic platform, as the use of any person of Noon Star store, whether a consumer of the store's service or product or otherwise, this is an approval and acceptance from him and he is fully qualified according to Sharia, system and law for all the articles and provisions of this agreement and it is a confirmation of your commitment to its regulations and what is mentioned therein, and this agreement applies to all types of dealings between the user and the store except for dealings related to personal status and dealings related to issuing deeds related to the actions contained in the property. This agreement is considered valid and effective once you approve it and start registering with Noon Star store in accordance with Article 10 of the Saudi Electronic Transactions System.

Article One - Introduction and Definitions:

The above introduction is an integral part of this Agreement. Below you will find the meanings and definitions of the main terms used in this Agreement:

1. (Store) This term refers to the Noon Star Store, and this definition includes all forms of the Noon Star Store on the Internet, whether it is an electronic application, a website on the Internet, or a commercial store.

2. (User) This term refers to every consumer who purchases the product or service from the store through its electronic platform.

3. (Agreement) This term means the terms and conditions of this Agreement, which govern and regulate the relationship between the parties to this Agreement.

Article Two - User's Legal Capacity:

1. The user acknowledges that he has the legal capacity recognized by Sharia and the system to deal with the store, or that he is not less than eighteen years old.

2. The user agrees that if he violates this article, he will bear the consequences of this violation before third parties.

Article Three - The nature of the commitment of Noon Star Store:

1. Noon Star Store’s commitment to consumers or users is to provide (the service or product).

2. Noon Star Store may provide other services such as after-sales services or other related services, depending on the nature and type of (service or product) requested by the user.

Article Four - Controls for using the Noon Star Store:

1. The user is committed to using the electronic platform of Noon Star Store in accordance with public morals and the regulations in force in the Kingdom of Saudi Arabia.

2. When purchasing a service or product from the Noon Star Store, the user undertakes not to use this service or product in a manner that violates public morals and the regulations in force in the Kingdom of Saudi Arabia.

Article Five - Accounts and Registration Obligations:

Upon applying to join the membership of Noon Star Store as a user, you are obligated to disclose specific information and choose a username and a secret password to be used when accessing the services of Noon Star Store. Thus, you have agreed to:

1. You are responsible for maintaining the confidentiality of your account information and password, and you agree to notify Noon Star Store immediately of any unauthorized use of your account information at Noon Star Store or any other breach of your confidential information.

2. Noon Star Store will not be responsible in any way for any loss that may be incurred by you directly or indirectly, morally or materially, as a result of revealing your username or password information.

3. You are committed to using your account or membership at Noon Star Store yourself, as you are fully responsible for it, and if someone else uses it, this is evidence that you have authorized him to use the store in your name and on your behalf.

4. You agree, when using the Noon Star store, to use it with all seriousness and honesty.

5. You undertake to disclose true, correct, current, complete and legal information about yourself as required during registration with Noon Star Store and you undertake to update your data in the event of a change in reality or if necessary.

6. Noon Star Store is committed to treating your personal information and contact addresses with complete confidentiality.

7. If Noon Star Store finds that you have disclosed information that is false, incorrect, outdated, incomplete, illegal, or in violation of the User Agreement, Noon Star Store has the right to suspend, freeze, or cancel your membership, store, or account on the platform, without prejudice to Noon Star Store’s other rights and legitimate means of recovering its rights and protecting the rest of the users.

8. In the event of non-compliance with any of the above, the Noon Star Store management has the right to suspend or cancel your store or membership or block you from accessing the Noon Star Store services again.

Steps to delete your account from the application:

1. Open the app: Make sure you are logged in to your account.
2. Go to the Account tab: Find the Account or Settings tab in the app.
3. Log in (if necessary): If you are not already registered, enter your username and password.
4. Click the “Edit Account” button: Look for the “Edit” or “Manage Account” button.
5. Scroll down the page: You'll find your account information, including your username, email, and other data.
6. Click the “Delete Account” button: This button is usually located at the bottom of the page or near the other account options.
7. Read the warning carefully: Make sure to read the warning that appears on the screen. This warning will remind you to permanently delete all of your account data.
8. Click “Confirm Deletion”: If you are sure you want to delete your account, click the “Confirm Deletion” button.

Important Notes:

• Account deletion is irreversible: Once you confirm the deletion, all of your account data will be permanently deleted.
• Make sure to save any important data before deleting your account: you won't be able to access this data after you delete your account.
• If you have any problems deleting your account: Please contact the app support team for assistance.

Additional tips:

• Change your password: If you are concerned about the security of your account, you can change your password.
• Email Reporting: You can also email the app support to request deletion of your account.

Using these simple steps, you can easily delete your account from the app.

Article Six - Electronic Communications and Official Means of Communication:

1. The parties to this agreement agree that communication shall be via the email registered on the platform.

2. The User agrees that all agreements, notices, statements and other communications provided to him electronically are equivalent to their written counterparts, and are self-contained evidence, in meeting regulatory and legal requirements.

3. The user agrees to the possibility of communicating with him and informing him of any provisions related to this agreement or related to dealing with him by the management of the Noon Star Store broadcasting general messages to all users or to specific users of the Noon Star Store.

Article Seven - Amendments to the User Agreement and Fees:

1. Noon Star Store may notify you of any amendment to this agreement in accordance with the official means of communication under this agreement, and accordingly your obligations will be doubled or your rights will be diminished in accordance with any amendments that may be made to this agreement.

2. In the event of an objection to any amendment to the User Agreement, Noon Star Store hopes that you will stop using its services, as your mere access to your account in Noon Star Store or your use of Noon Star Store constitutes your acceptance of the amendments and full and complete consent that negates ignorance, and Noon Star Store accepts discussion of any suggestion regarding these provisions.

3. All fees are calculated in Saudi Riyals, and the user must pay all fees due on the platform, in addition to any other expenses added by the Noon Star store, provided that payment is made through the approved, specified and available means through the Noon Star store.

4. Noon Star Store may impose fees on some users, depending on the offers, products or services they request, or the fees or taxes imposed by the state on the nature of the product or service.

5. Noon Star Store reserves the right to add, increase, reduce or deduct any fees or expenses under the articles, terms and provisions of the User Agreement, for any user, regardless of the reason for their registration.

Article Eight - Payment and settlement services for stores in the Noon Star store:

1. Noon Star Store provides, through its partners, the payment and settlement system in Noon Star Store. It can be done entirely online through the payment options available in Noon Star Store or through any payment method provided by Noon Star Store from time to time.

2. Noon Star Store is committed to setting the price of the service or product it displays in its store according to the recognized market value.

3. Noon Star Store is committed to providing invoices, receipts, and receipts for all amounts and profits generated in its store, and is committed to giving the user an invoice for his purchase of a service or product (store name).

4. Noon Star Store is committed to providing the generally accepted accounting specifications in its online store, in application of the provisions of this agreement, and for the legal, economic, commercial and organizational interests in this organization.

Article Nine - Your Personal Information and Transaction Details Information:

1. The user acknowledges that he grants Noon Star Store an unlimited, global, permanent, irrevocable, free of charge, and licensed right to use personal or other information or materials provided or supplied by the Noon Star Store platform or announced on the platform by joining or using it, through the forms designated for communication and registration, or via any electronic message or any of the communication channels available on the platform. This is for the purpose of achieving any of the interests that the platform deems appropriate.

2. The provisions of confidentiality of consumer information are subject to the rules of the “Privacy and Confidentiality Policy” of Noon Star Store, and to the provisions contained in this agreement related to confidentiality of information.

Article 10 - Intellectual Property:

1. The intellectual property rights of Noon Star Store are rights owned by Noon Star Store in full, whether they were owned by them before or after the establishment of this electronic platform.

2. The user or consumer respects the intellectual property rights of Noon Star Store, which includes Noon Star Store itself, and the words, logos and other symbols of Noon Star Store or displayed on Noon Star Store, as Noon Star Store, and every right that follows Noon Star Store, are rights owned entirely by the intellectual property of Noon Star Store.

Article Eleven - Noon Star Store Responsibility:

1. Noon Star Store is committed to conducting its business through this electronic platform in a regular manner and in accordance with the regulations in force in the Kingdom of Saudi Arabia, and in accordance with the provisions of this agreement.

2. Noon Star Store shall not bear any claims arising from errors or negligence, whether caused directly, indirectly, incidentally, by the user or by a third party such as shipping companies.

3. Noon Star Store, its employees, owners and representatives are committed to ensuring that the (product or service) is sound, legitimate and authorized in accordance with the laws and regulations of the Kingdom of Saudi Arabia and is used for legitimate purposes.

Article Twelve - Confidentiality of Information:

1. Noon Star Store takes (tangible, organizational and technical) standards to protect users and prevent unauthorized access to and storage of users’ personal information.

2. You, as a user, acknowledge that the Internet is not a completely secure medium, and the confidentiality of your personal information cannot be 100% guaranteed through the Noon Star store.

3. Noon Star Store has no control over the actions of any third party, or others, such as other web pages linked through links to the platform or third parties claiming to represent you and others.

4. You acknowledge and agree that Noon Star Store may use your information that you have provided to it, for the purpose of providing services to you in Noon Star Store, and to send marketing messages to you, and that the privacy in Noon Star Store regulates the collection, processing, use and transfer of your personal identity information, and the rules of information confidentiality are subject to the “Privacy and Information Confidentiality Policy” of Noon Star Store.

Article Thirteen - Restriction of Access or Membership:

Noon Star Store may suspend or cancel a user’s membership or restrict a user’s access to the platform’s services at any time, without notice, for any reason, and without limitation.

Article Fourteen - Replacement Policy:

1. Without prejudice to the provisions of the contractual and statutory warranty, the consumer has the right to replace the product provided to him by the Noon Star store within seven days following the date of receipt of the product, and he does not have the right to replace the product after seven days have passed.

2. In order to replace the product, the product must be in good condition and the consumer must not have used the product or benefited from it. Noon Star Store has the right to inspect the product before replacing it to ensure its safety.

3. The consumer is not entitled to replace the product in the following cases:

If the product was manufactured based on the consumer’s request or according to specifications specified by him, with the exception of products that have a defect or that do not comply with the specifications specified by the consumer.

· If the product is video tapes, discs, CDs or software that has been used.

· If the product is newspapers, magazines, publications, books, or anything else considered to be works.

If the product is defective due to poor possession by the consumer.

· If the contract covers the provision of accommodation, transportation or catering services.

· If the contract deals with the purchase of software download products over the Internet.

Article Fifteen - Return Policy:

1. Without prejudice to the provisions of the contractual and statutory warranty, the consumer has the right to terminate the contract and return the product provided to him from the Noon Star store within seven days following the date of receipt of the product, and he is not entitled to that product after seven days have passed.

2. In order to return the product, it must be in good condition and the consumer must not have used the product or benefited from it. Noon Star Store has the right to inspect the product before returning it to ensure its safety.

3. The consumer is not entitled to return the product in the following cases:

If the product was manufactured based on the consumer’s request or according to specifications specified by him, with the exception of products that have a defect or that do not comply with the specifications specified by the consumer.

· If the product is video tapes, discs, CDs or software that has been used.

· If the product is newspapers, magazines, publications, books, or anything else considered to be works.

If the product is defective due to poor possession by the consumer.

· If the contract covers the provision of accommodation, transportation or catering services.

· If the contract deals with the purchase of software download products over the Internet.

4. If the provisions of the aforementioned return policy are met, the consumer has the right to terminate the contract and return the product to the Noon Star store with a refund of the amount paid.

Article Sixteen - Applicable law or regulation:

This User Agreement is governed by and formulated in accordance with the laws, regulations and legislation in force and in effect in the Kingdom of Saudi Arabia, and is fully and completely subject to the regulations in force with the authorities in the Kingdom of Saudi Arabia.

Article Seventeen - General Provisions:

In the event that any provision or clause contained in this User Agreement is cancelled or that any provision or clause contained in this User Agreement is no longer valid, such a matter does not cancel the validity of the remaining provisions, clauses and terms contained in the User Agreement and they remain valid until further notice from the management of the Noon Star Store.

This User Agreement - which may be amended from time to time as appropriate - constitutes the User Agreement, working mechanism, understanding, agreement and contract between Noon Star Store and the user. Both parties to this agreement also agree to take into consideration the following:

1. The Arabic language is the language used when interpreting the provisions of this agreement, or when translating it into another language.

2. All prices displayed on Noon Star Store services or products may be modified from time to time.

3. The promotional or marketing offers that Noon Star Store may put forward are temporary offers, as Noon Star Store has the right to modify or stop these promotional or marketing offers at any time.

4. The parties to this agreement are committed to dealing with each other in a manner that does not violate the Sharia rules, regulations and laws in force related to the nature of the dealings between the Noon Star store and the user.

5. This User Agreement shall not be cancelled except by a decision issued by the management of Noon Star Store.
